If you operate a rock quarry in San Diego County, recent changes to the zoning ordinance reduce regulation that would restrict recycling.
- Form of Ordinance for the amendment to the Zoning Ordinance, approve the introduction of the Ordinance (first reading);
- Read the title and waive further reading of the Ordinance for the amendments to the County Code;
- Adopt the revised standard "Defense and Indemnification Agreement" (POD 13-003), and;
- Adopt the Ordinance to change the zoning classification of a certain property within the County related to the Property Zoning Map Cleanup 2013 (POD 13-014) (first reading).
The board approved the amendment.
Of the items included in the Zoning Ordinance update Section 6158.e., “Accessory Use Regulations, Civic, Commercial, Industrial, or Extractive Use Types” and to Section 7357 “Effect of Use Permit on Other Use of the Property” are of interest to the construction aggregates industry.
The updated Ordinance would amend the language as follows:
- Section 6158. e. would allow recycling of salvaged concrete, asphalt and rock as a “by-right” accessory use without requiring an amendment to an existing use permit, subject to limitations, in conjunction with mining and processing use types, where rock crushing, asphalt production and/or concrete batching are occurring.
- Section 7357 regulations would be amended to include a reference to Section 6158.e which is an exemption to allow for recycling of salvaged concrete, asphalt and rock in conjunction with related mining and processing land uses without need to amend an existing Use Permit.
The Board approved the item on October 29, 2014 and adopted the Ordinance for the County Code amendments on December 3, 2014.
The limitations referred to in 6158 require that the operations must conform to all existing permit restrictions and conditions. The change allows a 10% increase in traffic and 25% increase in stockpiles. However, no increase in the size of the mining and processing site shall be authorized without a permit amendment.
